Trade union Solidarity today asked the Johannesburg Labour Court to declare the current Employment Equity Plan (for the period 2015 – 2019) of the South African Police Service (SAPS) invalid. Solidarity believes that this plan comes down to a quota system, as did the police’s previous employment equity plan that had already been declared invalid.
According to Anton van der Bijl, head of Solidarity’s Centre for Fair Labour Practices, Solidarity wants to ensure through court action that no further unfair discrimination takes place against anyone in the SAPS. “If implemented, the SAPS’s employment equity plans will constitute unfair discrimination. We believe that the plans are merely a smokescreen used by the police to enforce quotas according to the national racial demographics. This will mean that experience will be disregarded and service delivery will suffer,” Van der Bijl explained.
Van der Bijl said the outcome of the court case will affect thousands of positions in the police. “Among other things, Solidarity demands in its urgent court application that more than 5 000 positions in the police that had been advertised in February this year, should not be filled in accordance with the targets set out in the police’s current Employment Equity Plan,” Van der Bijl said.
The parties have presented their arguments and are awaiting the verdict.
